PERSON RESPONSIBLE FOR PROCESSING PERSONAL DATA

1. The data controller is Quizz Room, a simplified joint stock company with a capital of €1,266, registered with the Paris Trade and Companies Register, under number 841 563 042, whose head office is 9 rue Guénégaud, in Paris 75006.

2. Quizz Room is committed to complying with the provisions of Regulation (EU) No. 2016/679 of 27 April 2016 relating to the protection of personal data.

DATA COLLECTED

1. The data collected by Quizz Room may be directly transmitted by: - the User when browsing the Site or during the formation and execution of an order for products (the “Order”); - Participants, prior to or on the occasion of their arrival at Quizz Room establishments. This information includes: names, first names, postal address, email address, telephone number, date of birth and interests. zZ Room may also collect photographic representations of Participants, entered at opportunity of the game, after obtaining the agreement of the Participant.

2. Quizz Room may collect the above information about Participants, through the Buyer as part of the execution of the Agreement.

3. Quizz Room may also collect data through Cookies. A cookie does not personally identify a User but allows its sender to recognize the User's terminal and to collect a certain amount of information relating to the navigation carried out from this terminal. The User is invited to consult the section below devoted to Cookies.

4. Quizz Room may also collect data using standard Internet technologies such as Scripts and Pixels. These technologies make it possible to collect information relating to the use of the Quizz Room Site, to the presence of cookies on the User's Terminal, on whether or not to read emails sent by Quizz Room and the clicks made on the links contained in these emails.

DATA TRANSMISSION

A. Background

1. Personal data collected and processed by Quizz Room may be transmitted to: - Quizz Room partners who can process them on their behalf (the “recipients”), - Quizz Room partners who can process them on behalf of and according to instructions from Quizz Room (the “subcontractors”).

The recipients are: - the professional employees of Quizz Room, - the police authorities in the context of judicial requisitions concerning the fight against fraud, - the customs services in the event of delivery abroad, - commercial partners and in particular the marketing and advertising agencies

Quizz Room may use subcontractors for the following operations: - secure payment on the Site, - the fight against fraud and the collection of unpaid invoices, - the management of instant messaging, telephone calls, their possible recordings and the sending of postal letters, - the sending of postal letters, - the personalization of the content of the sites, - the personalization of the content of the sites, - the realization of technical maintenance and development operations of the website and the Quizz Room information system, - the collecting customer reviews, - sending commercial prospecting emails.
4. B. Transmission outside the EU

1. The data collected by Quizz Room is stored in the European Union.

In this case, Quizz Room ensures that personal data is only transferred, outside the European Union, to third countries that ensure an adequate level of protection and recognized as such by the European Commission, to companies certified under the Privacy Shield or companies guaranteeing an adequate level of protection through the existence of binding corporate rules, otherwise called Binding Corporate Rules.

1. In order to provide users with the control and visibility necessary for the processing of their personal data, Quizz Room guarantees the proper exercise of the rights available to users.

4. The request must be accompanied by proof of identity.
5. Quizz Room has one month to respond after receiving the request. An extension of the period of 2 months is possible taking into account the complexity and number of requests, provided that the person concerned has been informed within the initial period of one month.
6. In the event of exercising a right to oppose marketing profiling, the user is informed that he will continue to receive commercial requests but these will be less relevant and will no longer be targeted according to his areas of interest.
7. In the event of an absence of response or an unsatisfactory response, the person concerned has the option of referring the matter to the supervisory authority of his country of residence (CNIL.FR)

DIGITAL DEATH

1. The user has the right to define guidelines for the storage, deletion and communication of his data after his death. These guidelines may be general (concerning all processing of personal data) or specific (concerning only specific data processing).

DATA RETENTION PERIOD

1. The data processed is kept for a period that does not exceed that required for the purposes for which they are processed.
2. The starting point for the retention period of personal data differs depending on whether the User is a Buyer and/or a Participant (“customer” User) or not (“prospect” User):
- Customer: the starting point of the shelf life is the date of the last purchase or the last participation in a leisure activity offered by Quizz Room;
- Prospect: the starting point for the retention period is the date the account was created.
3. Some types of treatment have a specific shelf life. For example, invoices related to purchases are kept for 10 years; personal data collected when creating a Quizz Room account or a “Participant” or “Player” profile are kept for 5 years from the last activity; data relating to the execution of an order are kept for up to 5 years after the end of the execution of obligations; personal data collected during navigation on the Site are kept for 9 months from the last activity; the data personal data collected during the provision of the so-called Personalized Questions service are kept for up to three months after their communication by the Buyer.

SECURITY OF THE DATA COLLECTED

1. As a data controller, Quizz Room carefully monitors the security and confidentiality of the data collected and processed.
2. Quizz Room has appropriate security measures to ensure the security of the buildings housing its systems, the security of the computer system to prevent external access to personal data, and the fact of having secure copies of your data.
3. Quizz Room takes care to select subcontractors based on their ability to ensure the safety of the treatment through appropriate measures.
4. Quizz Room does not collect bank data from Buyers, the latter being redirected to the payment provider Stripe. Quizz Room invites Buyers to consult the page relating to the protection of the personal data of said service provider https://stripe.com/en-fr/legal#section_d.

DATA COLLECTED BY SOCIAL NETWORKS

1. Quizz Room invites you to use social networks to improve the commercial relationship and offer you targeted advertising offers on these networks.
2. The use of social networks to interact with Quizz Room is likely to lead to data exchanges between Quizz Room and these social networks.
3. Quizz Room invites you to consult the personal data management policies of the various social networks to find out what personal data may be transmitted by them.

COMMERCIAL PROSPECTING

Quizz Room can use your contact details to send you targeted advertising, in particular by email and SMS.

A. Prospecting by email and SMS

1. The prior and express collection of the user's consent is necessary for any sending of commercial prospecting by electronic means.
2. When creating a customer account on the Site, the user's consent is expressly requested to receive:

- Offers from Quizz Room partners to whom your contact details would be sent

3. Except as detailed below, Quizz Room will not send you personalized requests by email or SMS if you have not consented to them.

B. Retargeting advertising

1. Quizz Room may use the services of third parties whose role is to identify Internet users who have already visited our website and to send them personalized emails.
2. These companies use cookies to distinguish users and then to personalize the ads these users receive based on their browsing history.
3. This mechanism explains that a user who has browsed the Quizz Room site can receive an advertising email without having given their email address to Quizz Room.

1.1. PRO-FUN.COM SRL ou “Quizz Room“ ou "Quiz Room" ou le “Prestataire“ est une SRL, au capital de Stripe immatriculée au Registre du Commerce et des Sociétés de Namur, sous le numéro BE0801081923, dont le siège social est Chaussée de Dinant, 279, NAMUR, 5000, BELGIQUE et dont le numéro de TVA intracommunautaire est le 2 500,00€.

1.2. Quizz Room offre à la vente, afin de pouvoir conclure des contrats de vente (les « Contrats ») avec un consommateur (l’ « Acheteur ») :
a. à titre principal, la fourniture de services (les « Services ») relatifs à la réservation de salles de loisirs (les « Salles »), par laquelle Quizz Room met une ou plusieurs Salles à la disposition d’individus prenant part aux activités de loisirs offertes dans les Salles (les « Participants ») ; s’il participe auxdites activités, l’Acheteur est réputé être un Participant ;

b. à titre accessoire, des produits (les « Produits ») de divertissement, en lien avec les Services.

SECTION 2. OBJECT

  1. 2.4 The General Conditions are accessible on the Site and in all Quizz Room establishments; subject to any special conditions applicable to a specific type of Services, specified separately and prior to the conclusion of any Contract, the GCS apply to the exclusion of all other conditions.
  2. 2.3. The purpose of these General Terms and Conditions of Sale (the “General Conditions” or “CGV”) is to define the rights and obligations of the Buyer and Quizz Room under the Contracts:

    a. These General Terms and Conditions may be amended at any time by Quizz Room;
    b. they are applicable as soon as they are put online but any changes will not apply to transactions already in progress when these changes are put online;
    c. the last revision of the GTC was carried out on 25 October 2024.

SECTION 3. PRE-CONTRACTUAL INFORMATION

  1. 3.5 Prior to the immediate purchase or the placing of the order and the conclusion of the contract, these general conditions of sale are communicated to the Buyer.
  2. 3.6 The Buyer acknowledges having been provided, prior to placing his order and concluding the contract, in a legible and understandable manner, of the General Conditions and all the information listed in article L. 221-5 of the Consumer Code.
  3. 3.7 The following are thus transmitted to him in a clear and understandable manner:
    - the essential characteristics of the services and products (if they are offered for sale in this center)
    - the prices of services, products, (if they are offered for sale in this center) and ancillary costs or, where applicable, their method of calculation;
    - in the absence of immediate execution of the contract, the date or the period by which the seller undertakes to deliver the product or perform the service, regardless of its price;
    - information relating to the identity of the seller, i.e. his name or his corporate name, the geographical address of his establishment and, if different, that of the head office, his telephone number and his email address as well as information relating to his activities;

    - in the event of a sale, the existence and the procedures for exercising the legal guarantee of conformity provided for in articles L. 217-1 and following of the Consumer Code, of the guarantee against hidden defects provided for in articles 1641 and following of the Civil Code, as well as, where applicable, of the commercial guarantee and after-sales service respectively referred to in articles L. 217-15 and L. 217-17 of the Consumer Code, as well as, where applicable, of the commercial guarantee and after-sales service respectively referred to in articles L. 217-15 and L. 217-17 of the Consumer Code;
    - the duration of the contract, when it is concluded for a fixed term, or the conditions for its termination in the case of a contract of indefinite duration;
    - where applicable, any relevant interoperability of digital content with certain hardware or software of which Quizz Room is or should reasonably be aware.
  4. 3.8 The Buyer declares to have read these general conditions of sale and to have accepted them before his immediate purchase or the placing of his order: they are enforceable against him in accordance with the terms of article 1119 of the Civil Code.

SECTION 4. PUBLICATION OF REVIEWS

  1. 4.9 For a period that may not exceed twenty-four (24) months, Quizz Room may broadcast on its site extracts of opinions posted by consumers without compensation and collected through one or more third parties who do not verify them. These opinions cannot be contractual in nature.

SECTION 5. PRODUCTS AND SERVICES OFFERED BY QUIZZ ROOM

  1. 5.10 During the hours available for reservation and according to the number of Participants indicated by the Buyer, Quizz Room offers for sale Services for the reservation and provision of one or more Rooms including the option of using a question and answer game whose characteristics are as follows:
    - audiovisual communication of questions to the attention of the Participants;
    - provision of a pager allowing Participants to answer questions individually or collectively;
    - automatic counting of the points of each of the Participants;
    - multiple game mechanics belonging to Quizz Room and that can be modified over time.

    5.11 The use of the Recreation Room equipment is subject to the presence of at least three (3) Participants, without these being able to exceed eighteen (18).

    5.12 In addition to booking and providing Rooms, Quizz Room can provide a personalization service of ten (10) questions called “Personalized Questions”:

    a. ordering the Personalized Questions service offers the Buyer the possibility to fill in, in an online space on the Site dedicated to this purpose, all the questions that he wishes to submit to the Participants in execution of his Order;
    b. the Buyer must fill in the dedicated space mentioned in the preceding paragraph, these questions no later than the day before the availability of the Reserved Room (s);
    c. During the provision of services ordered from it, Quizz Room reproduces and distributes, without any content verification for which the Buyer is solely responsible, the content of the questions as provided to it by the Buyer or the Participants;
    D. Quizz Room declines any responsibility relating to the terms of the Personalized Questions broadcast in the Room and it is the sole responsibility of the Buyer to ensure that they are lawful.

    5.13 At the express request of the Buyer and prior to the conclusion of any Contract, the Buyer may contact Quizz Room to order the provision of additional personalized services, which will be the subject of a quote issued by Quizz Room.

    5.14 For the purpose of performing the Services, the score obtained by each Participant at the end of their participation in the Quizz Room will be kept by Quizz Room.

    5.15 Additionally, Quizz Room offers for sale, within the limits of available stocks, various products whose nature and characteristics are set out on the Site. The products are described and presented as accurately as possible. However, if errors or omissions may have occurred in this presentation, the seller could not be held responsible. Product photographs are not contractual.

SECTION 6. PRICES OF PRODUCTS AND SERVICES

6.16 Le prix des Produits ou Services mis en vente sur le Site est fixé librement par Quizz Room, dans le respect des lois et règlements applicables.

6.17 Le prix unitaire de chaque Produit ou Service est affiché sur la page de présentation dudit Produit ou Service diffusée sur le Site.

6.18 Quizz Room se réserve le droit de modifier ses prix à tout moment mais s’engage à appliquer les tarifs en vigueur indiqués au moment de la commande de fourniture de Produits ou Services (la « Commande »), le cas échéant sous réserve de disponibilité à cette date.

6.19 Le prix des Services et des Produit n’est pas négociable par l’Acheteur.

6.20. Les prix des Services et des Produits sont indiqués en euros et sont fixés toutes taxes comprises telles qu’en vigueur au jour de la commande : toute création ou modification de taxe qu’elle qu’en soit la nature ou le montant sera appliquée aux Contrats y compris pour les commandes en cours, dès son entrée en vigueur. Les prix affichés ne tiennent pas compte des éventuels frais de livraison et autres frais annexes nécessaires à l’exécution de la Commande qui sont seront facturés en supplément et, indiqués avant la validation de la Commande.

6.21 Pour la Commande de certaines prestations de services ad hoc ou personnalisées, Quizz Room peut être amenée à établir un devis préalable, dont la durée de validité est de dix (10) jours et sur lequel figurera le prix de chaque Service sollicité.

ARTICLE 7, ORDERS FOR PRODUCTS AND SERVICES

  1. 7.22 The Order is made online, from the catalog of Products and Services published on the Site and by means of an online ordering process made available to the Buyer via the Site, within the limits of current availability.
  2. 7.23 With regard to the Services, after clicking on the “Book” tab, the Buyer selects the desired reservation date and time, the number of Participants, the duration of the reservation and, where applicable, the type of quiz he intends to have, the reason for his arrival as well as the reservation of a post-quiz rest area as well as the reservation of a post-quiz rest area in addition to other additional services and Products from a list offered to him; once his choices have been made, the Buyer clicks on the “Add to Cart” tab.
  3. 7.24 With regard to the Products, the Buyer selects one or more of them and their possible options, which he places in a virtual basket, within the limits of available stocks.
  4. 7.25 The Buyer identifies himself with Quizz Room by indicating his first name, last name, e-mail, telephone number and address. QUIZZ ROOM informs the Buyer that he has the right to subscribe to a list of objections to telephone canvassing, accessible via the following link: https://www.bloctel.gouv.fr/

    7.26 After having indicated or not the beneficiary of a possible discount code, selected his method of payment, consulted the summary of his Order as well as the CGV and the confidentiality policy that he accepts by clicking on the place indicated, the Buyer validates his Order;
  5. a. any validation of the Order by the Buyer implies acceptance of the price and characteristics of the Products and Services selected so that any dispute on these points will only occur within the framework of the possible implementation of the guarantees set out below;
    b. any validation of the Order by the Buyer implies irrevocable acceptance of these General Conditions by the Buyer;
  6. 7.27 The Buyer pays for his Order and, within four (4) hours from payment, receives an email from Quizz Room confirming or denying his Order; the confirmation is an exceptional case.
  7. 7.28 The sale is considered final after:

    a. Sending to the Buyer, by email from Quizz Room, a confirmation of the Order;
    b. receipt of the full price or, where applicable, of a deposit by Quizz Room, which retains the right to suspend or refuse the Buyer's Order in the event that the debit was not possible

    7.29 For any question relating to the follow-up of his Order, the Buyer must contact the Seller directly.

SECTION 8. TERMS OF PAYMENT FOR SERVICES ORDERED


8.30 Dès la validation de la Commande par l’Acheteur, le paiement de la totalité du prix est dû par l’Acheteur à Quizz Room.

8.31 L’Acheteur devra régler en ligne le prix des Services en utilisant une des options suivantes par carte bancaire : Carte Bleue, e-carte bleue, Visa, Mastercard, Carte American Express.

8.32 La transaction et l’encaissement du produit des ventes effectuées via le Site sont réalisés via un ou plusieurs prestataires de paiements tiers, identifié préalablement au paiement par l’Acheteur de ses Produits et Services et il appartient à ce dernier de consulter les Conditions Générales d’Utilisation du Prestataire, préalablement à toute transaction, via le lien URL qui apparaît dans la page de paiement des Produits et Services.

SECTION 9. PROOF OF TRANSACTIONS

  1. 9.33 The online provision by the Buyer of his bank card number and the final validation of the order will constitute proof of the Buyer's agreement to:

  2. 9.35 In addition, the computerized records, kept in the computer systems of Quizz Room and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
  3. 9.36 The archiving of purchase orders is carried out on a reliable and durable medium that can be produced as proof.

SECTION 10. ACCESS TO THE ROOMS

  1. 10.37 Access to the Rooms reserved by the Buyer is subject to the prior payment of the full price of the Services and Products.
  2. 10.38 Access to the Rooms is prohibited to Participants under the age of fifteen (15), unaccompanied by at least one adult who is himself a Participant or not.
  3. 10.39 The delay of one or more Participants has no effect on the schedule and duration of the provision of the Reserved Rooms: they cannot be postponed or extended beyond the limits provided for in the Order and the Room must therefore be vacated at the time initially set; after a delay of fifteen minutes, the capacity of the room's equipment and the duration of the game will necessarily be reduced.
  4. 10.40 The equipment and furniture located in the Quizz Room establishments are made available to the Participants and the Buyer, subject to fair and delicate use, without the slightest degradation or damage being inflicted on them.
  5. 10.41 The introduction of a drink, whether alcoholic or not, into the Hall is prohibited.
  6. 10.42 Quizz Room reserves the right to refuse access to the Rooms in the event that at least one Participant is intoxicated or under the influence of illicit substances or has a threatening, aggressive or violent behavior.

SECTION 11. RESERVATION CHANGES


1. Sauf dans le cas où elle serait exclusivement imputable à Quiz Room, l’annulation de la Commande est impossible et l’absence des Participants à la date et à l’heure de la mise à disposition de la Salle ne peut pas donner lieu à restitution des sommes versées en contrepartie de la Commande des Services.

2. L’Acheteur a la faculté de modifier, gratuitement, la date et l’horaire de la réservation jusqu’à sept jours avant la mise à disposition effective de la ou des Salles en cliquant sur le lien prévu à cet effet dans l’e-mail de confirmation de la Commande émis par Quizz Room ; passé le délai susmentionné, aucune modification n’est possible.

3. La réduction du nombre de Participants est sans conséquence sur le montant initial de la Commande et Quizz Room ne pourra pas restituer à l’Acheteur les sommes qu’il a initialement versées.

4.La variation à la hausse du nombre de Participants est possible à tout moment, sous réserve de l’exécution de l’obligation de paiement prévue à l’article V-5-d et dans la limite de :
  • 18 Participants en cas de mise à disposition d’une seule Salle ;
  • 36 Participants en cas de mise à disposition de deux Salles ;
Au-delà des limites susmentionnées, Quiz Room se réserve le droit de refuser l’accès aux Salles à certains Participants.

5. L’annulation du service de Questions Personnalisées est impossible et, sauf manquement directement et exclusivement imputable à Quiz Room, la non-communication, par l’Acheteur, des Questions Personnalisées ne peut donner lieu à restitution des sommes versées en contrepartie de l’achat de ce service.


11.43 Sauf dans le cas où elle serait exclusivement imputable à Quizz Room, l’annulation de la Commande est impossible et l’absence des Participants à la date et à l’heure de la mise à disposition de la Salle ne peut pas donner lieu à restitution des sommes versées en contrepartie de la Commande des Services.

11.44 L’Acheteur a la faculté de modifier, gratuitement, la date et l’horaire de la réservation jusqu’à cinq jours avant la mise à disposition effective de la ou des Salles en cliquant sur le lien prévu à cet effet dans l’e-mail de confirmation de la Commande émis par Quizz Room ou en contactant directement Quizz Room par email ou téléphone ; passé le délai susmentionné, aucune modification n’est possible.

11.45 La réduction du nombre de Participants est sans conséquence sur le montant initial de la Commande et Quizz Room ne pourra pas restituer à l’Acheteur les sommes qu’il a initialement versées ; elle sera en revanche compensée par l’octroi d’un bon de Commande valable 1 (un) an et dont le montant correspond à la différence entre le prix total de la Commande initiale et la somme des prix par Participant présent ; pour être valable, le bon de Commande doit être sollicité par l’Acheteur, avant l’expiration d’un délai de cinq (5) jours à compter de la date de mise à disposition effective de la Salle, à l’adresse suivante :

11.46 La variation à la hausse du nombre de Participants est possible à tout moment, sous réserve de l’exécution de l’obligation de paiement prévue à l’article V-5-d et dans la limite de :
  • 18 Participants en cas de mise à disposition d’une seule Salle ;
  • 36 Participants en cas de mise à disposition de deux Salles ;
  • 54 Participants en cas de mise à disposition du trois Salles ;
  • 72 Participants en cas de mise à disposition du quatre Salles ;
Au-delà des limites susmentionnées, Quizz Room se réserve le droit de refuser l’accès aux Salles à certains Participants.

11.47 L’annulation du service de Questions Personnalisées est impossible et, sauf manquement directement et exclusivement imputable à Quizz Room, la non-communication, par l’Acheteur, des Questions Personnalisées ne peut donner lieu à restitution des sommes versées en contrepartie de l’achat de ce service.

SECTION 12. UNAVAILABILITY OF THE PRODUCTS ORDERED

  1. 12.48 The delivery of the Products means the transfer to the Buyer of the physical possession or control of the goods. It is only initiated after confirmation of payment by Quizz Room's banking organization.
  2. 12.49 Intangible Products, such as e-gift cards, are delivered intangible to the Buyer as soon as Quizz Room confirms the corresponding order by Quizz Room, by means of electronic correspondence sent to the email address provided by the Buyer or made available to him in his personal space on the Site in the event of the creation, at the initiative of the Buyer, of such a space.
  3. 12.50 Except in the case of unavailability set out below, the other Products sold by Quizz Room are collected directly by the Buyer at the Quizz Room premises at the address shown in paragraph 1. above, on the day on which the provision of one or more Rooms ordered by the Buyer is made available.
  4. 12.51 In the event of the unavailability of one or more Products ordered by a Buyer on the day of the execution of the service of providing one or more Rooms, the said products are sent to the Buyer by post within a period that may not exceed 20 days and at the expense of Quizz Room and at the expense of Quizz Room if the Buyer's address is located in the same territory as the local Quizz Room. If the Products are not shipped within the above period, the Buyer may freely notify Quiz Room, by registered letter with acknowledgement of receipt, of the cancellation of the contract and it will be considered resolved upon receipt by the seller of the letter or writing informing him of this resolution, unless the professional has acted in the meantime. When the contract is cancelled, Quizz Room is required to reimburse the Buyer for all amounts paid, at the latest within 14 days following the date on which the notification of contract resolution was received by Quizz Room.
  5. 12.52 The products are delivered to the address indicated by the Buyer and it is his responsibility to ensure their accuracy. Any package returned to Quizz Room due to an incorrect or incomplete delivery address will be returned at the expense of the Buyer. The Buyer may, at his request, obtain the sending of an invoice to the billing address and not to the delivery address, by validating the option provided for this purpose on the order form.
  6. 12.53 If the Buyer is absent on the day of delivery, the delivery person will leave a notice in the letterbox, which will allow the package to be collected at the place and during the period indicated.
  7. 12.54 If at the time of delivery, the original packaging is damaged, torn or opened, the Buyer must then check the condition of the items. If they have been damaged, the Buyer must absolutely refuse the package and note a reservation on the delivery note (package refused because opened or damaged).

    12.55 The Buyer must indicate on the delivery note and in the form of handwritten reservations accompanied by his signature any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products...).

    12.56 This verification is considered to have been carried out once the Buyer, or a person authorized by him, has signed the delivery note.

    12.57 The Buyer must confirm his reservations by registered mail to the carrier at the latest within two (2) working days following receipt of the item (s) and send a copy of this letter by fax or simple letter to the seller at the address indicated in the legal notice of the site.
12.58 Si les Produits nécessitent d'être renvoyés au vendeur en raison d’une erreur de livraison ou de non-conformité des produits en nature ou en qualité par rapport aux indications figurant sur le bon de commande, ils doivent faire l'objet d'une demande de retour auprès du vendeur dans les 7 jours suivant la livraison. Toute réclamation formulée hors de ce délai ne pourra être acceptée. Le retour du produit ne pourra être accepté que pour les produits dans leur état d'origine (emballage, accessoires, notice...).

SECTION 13. RISK TRANSFER

  1. 13.59 The transfer of ownership and the associated risks of loss and deterioration occurs as soon as the sale is final. The Products travel at the risk and peril of the Buyer.

SECTION 14. GUARANTEES

  1. 15.72 With regard to tangible property, QUIZZ ROOM guarantees their compliance with the contract, allowing the Buyer to make a request under the legal guarantee of conformity (provided for in current article L.217-4 of the Consumer Code) or the guarantee against defects in the item sold within the meaning of the provisions of article 1641 of the Civil Code.
  1. Appendix to article D.211-2 of the Consumer Code:

    “The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its occurrence.
    When the contract for the sale of the good provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee is applicable to this digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance.
    The legal guarantee of conformity implies an obligation for the professional, where applicable, to provide all the updates necessary to maintain the conformity of the property.
    The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of their request, at no cost and without major inconvenience for them.
    If the goods are repaired under the legal guarantee of conformity, the consumer benefits from an extension of the initial warranty of six months.
    If the consumer requests the repair of the goods, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
    The consumer can obtain a reduction in the purchase price by keeping the goods or terminate the contract by being reimbursed in full against return of the goods, if:

    1° The professional refuses to repair or replace the property;
    2° The repair or replacement of the goods takes place after a period of thirty days;
    3° The repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if they bear the costs of installing the repaired goods or replacing them;
    4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into compliance.
    The consumer is also entitled to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies the immediate reduction in the price or the termination of the contract. The consumer is then not required to request the repair or replacement of the goods in advance.
    The consumer is not entitled to have the sale resolved if the lack of conformity is minor.
    Any period of immobilization of the property in order to be repaired or replaced suspends the warranty which remained to run until the delivery of the refurbished property.
    The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.
    “A seller who obstructs the implementation of the legal guarantee of conformity in bad faith incurs a civil fine of a maximum amount of 300,000 euros, which can be increased up to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

    The consumer also benefits from the legal guarantee against hidden defects pursuant to articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the property is retained or to a full refund against return of the property.”

SECTION 15. RIGHT OF WITHDRAWAL

  1. 15.62 The Products must however be returned in their original packaging, in perfect condition within fifteen (15) days following the notification to the seller of the buyer's decision to withdraw.

    15.63 Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing them to be marketed in new condition, accompanied by the purchase invoice.

    15.64 Damaged, soiled or incomplete products are not taken back.

    15.65 The right of withdrawal can be exercised online, using the withdrawal form available on the website published by Quizz Room and attached below. In this case, an acknowledgement of receipt on a durable medium will be immediately communicated to the Buyer. Any other method of declaring withdrawal is accepted. It must be unambiguous and express the will to withdraw.

    15.66 In case of exercise of the right of withdrawal within the above period, the price of the product (s) purchased is reimbursed and the delivery costs are reimbursed.

    15.67 The return costs are the responsibility of the Buyer.

    15.68 The exchange (subject to availability) or the refund will be made within a period of fourteen (14) days from the receipt, by the seller, of the products returned by the buyer under the conditions provided for above.

    15.69 As an exception and in accordance with the provisions of article L221-28-12° of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of leisure activities that must be provided on a specific date or period and, for the services of reservation and provision of Rooms, the Buyer therefore does not benefit from a right of withdrawal.

SECTION 16. OFFERS AND GIFTS

  1. 16.70 After the provision of a Room and the use of the game offered by Quizz Room, the Participant declared the winner of the game benefits from an Order form and a Room reservation for two (2) games and for a number of players identical to that of the session that gave rise to the said Order Form, valid until the expiration of a period of three months from the first day of the month following the month in which the Room has been made available to the Buyer.

    16.71 Obtaining the Order form is obtained by the issuance, by Quizz Room, of an email specifically provided for this purpose or, failing that, by a request for obtaining an Order issued by any means by the Participant declared the winner, before the expiration of a period of seven (7) days from the effective availability of the Room.

SECTION 17. BELGIAN CUP QUIZ


17.72 Quiz Room ainsi que tous les responsables d’un établissement exploitant les Services de Quiz Room se réservent la faculté de vous proposer de participer à un Tournoi national organisé annuellement par Quiz Room, intitulé « Coupe de Belgique de Quiz ».

17.73 La Participation audit Tournoi est gratuite et proposée aux Participants sous réserve que ceux-ci aient :

a. réalisé l’un des 12 meilleurs scores d’un centre Quiz Room à l’occasion de la consommation antérieure de Services ; ou
b. obtenu une victoire à l’un des Tournois ad hoc dédié à cet effet, organisé par Quiz Room PRO-FUN.COM SRL ou l’un de ses Délégués.

17.74 Les termes et condition du Règlement du Tournoi sont accessibles ici.

17.75 En aucun cas, la consommation de Services selon les conditions et modalités prévues par les présentes, ne peut être constitutive ou perçue comme constitutive d’une participation audit Tournoi, ni d’une proposition de participer audit Tournoi.

SECTION 18. RESPONSIBILITIES

  1. 18.76 Only facts that are directly attributable to Quizz Room may engage the responsibility of Quizz Room towards the Buyer or the Participants, subject to causing them direct harm.

    18.77 Quizz Room cannot be held liable in the event that the non-performance or poor performance of its obligations is attributable to:
    a. Misuse of the Room and its functionalities by the Buyer or by any Participant;
    b. a fault attributable to the Buyer or to any Participant;
    c. a case of force majeure, i.e. an unforeseeable and insurmountable fact by a third party and in particular: a general strike by public transport drivers followed by more than 50% by the professionals concerned, a technical failure of the game making it impossible for all Participants to use it, an administrative closure of the Quizz Room establishment;
    d. a technical failure in the game that does not make it impossible for all participants to use it;
    e. the disadvantages inherent in the use of the Internet network — such as an interruption or interruption of service, an external intrusion or the presence of computer viruses.

    18.78 In the event that the provision of a Room and the use of the game by all Participants prove impossible as a result of a case of force majeure, Quizz Room undertakes to postpone the execution of the Services ordered free of charge before the expiration of a period of three months from the date of initial availability; at the end of this period, in the event that the new execution dates proposed by Quizz Room are not appropriate not to the Buyer and subject to having received from the latter a request for a deferral relating to Minus ten new dates included in the three-month period mentioned above, Quizz Room will refund the amounts initially paid by the Buyer.

    18.79 In the event that the Buyer has requested the Personalized Questions service:
    a. Only the Buyer can be held responsible for the content of the Questions submitted to Quizz Room;
    b. the Buyer and the Participants release Quizz Room from any liability in the event that these Questions cause harm of any kind to any Participant or to a third party;
    c. Quizz Room reserves the right not to broadcast Questions whose content is clearly illegal or would be harmful to morality and its decision cannot in any way justify a refund of the amounts paid by the Buyer in return for the Personalized Questions service.

    18.80 The Buyer undertakes to identify and guarantee Quizz Room against all liability, recourse and all requests relating to the Services ordered by the Buyer and whose non-performance would be attributable to the latter.

    18.81 The Buyer promotes the fair use of leisure equipment by all Participants and guarantees Quizz Room against any deterioration or damage of any kind to goods, equipment, materials and persons inflicted by any Participant during the performance of the Services; the Buyer cannot in any way oppose Quizz Room to the absence of a relationship of subordination or contractual relationship with a Participant to avoid the obligations imposed on him.

    18.82 In the event of damage inflicted by one or more Participants linked to the Buyer's Order to the goods or equipment belonging to Quizz Room establishments, the repairs will be evaluated and notified to the Buyer within sixty (60) days; the Buyer will have a period of fifteen days from the notification issued by Quizz Room to pay the cost of the repairs, without delay in recourse to insurance.

SECTION 19. INTELLECTUAL PROPERTY

  1. 19.83 The content of the Site as well as the products and representations appearing within the premises of Quizz Room establishments (technical documents, drawings, photographs, etc.) are protected by copyright, trademarks or patents.
  2. 19.84 The Buyer and the Participants undertake not to make any non-personal use of this content without the prior agreement of Quizz Room.

    19.85 Any total or partial reproduction of this content, without the prior authorization of Quizz Room, is strictly prohibited and may constitute an offense of counterfeiting.

    19.86 The content of the Personalized Questions remains the property of the Buyer, who is deemed to be the author; Quizz Room undertakes to exercise only a one-time distribution right and strictly limited to the duration of the effective provision of the Room; within a reasonable period of time from the expiration of the duration of the provision of the Room, Quizz Room undertakes to delete the content of these Questions from its databases.

SECTION 20. PERSONAL DATA

  1. 20.87 The personal data provided by the Buyer are necessary for the processing of his order and for the establishment of invoices.
  2. 20.88 They are subject to computer processing.
  3. 20.89 The buyer has a right of permanent access, modification, correction and opposition with respect to information concerning him.

    20.90 The Buyer is invited to consult the Charter relating to the protection of Personal Data on the Site to take note of all the information relating to this subject.

SECTION 21. MEDIATION


21.92 Conformément aux articles du code de la consommation L611-1 et suivants et R612-1 et suivants, il est prévu que pour tout litige de nature contractuelle portant sur l'exécution du contrat de vente et/ou la prestation de services n'ayant pu être résolu dans le cadre d'une réclamation auprès de notre service client et en cas d’échec ou en l’absence de réponse de Quizz Room à l’expiration d’un délai de deux mois, l'Acheteur pourra recourir gratuitement à la médiation.

Il contactera l'ANM CONSOMMATION soit par courrier en écrivant au 2 rue de Colmar 94300 Vincennes (en précisant obligatoirement en sus de ses propres coordonnées, le numéro de téléphone et l'adresse mail de Quiz Room) soit sur le site de l'ANM CONSOMMATION en remplissant le formulaire de saisine en ligne à l'adresse suivante https://www.anmconso.com. Pour plus d'informations, l'Acheteur peut contacter l'ANM CONSOMMATION par téléphone au 01 58 64 00 05, du lundi au vendredi de 9h00 à 12h00.

En outre, l’Acheteur est informé de l’existence d’une plateforme de règlement en ligne des litiges commerciaux, développée par la Commission européenne en application des dispositions du Règlement (UE) N° 524/2013 du Parlement européen et du Conseil du 21 mai 2013 relatif au règlement en ligne des litiges de consommation (RLLC), dans le but de faciliter le règlement extrajudiciaire des litiges concernant des obligations contractuelles découlant de contrats de vente ou de service en ligne entre un consommateur résidant dans l'Union européenne et un professionnel établi dans l'Union européenne. SECTION 22. INTEGRALITY

  1. 22.94 In the event of the disappearance of one of the clauses of these General Conditions, in particular as a result of the application of a law, a regulation or following a final decision by a competent court, the other provisions of these General Conditions will remain in full force and scope.

    22.95 If a condition of sale were lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their headquarters in Belgium.

SECTION 23. VARIOUS

  1. 23.96 Any notice interrupting the delay is appreciated for this purpose at the time of dispatch.

    23.97 Any notice that is subject to a delay is considered for this purpose at the time of its receipt.

SECTION 24. APPLICABLE LAW AND JURISDICTION

  1. 24.98 The General Terms and Conditions are subject to French law.

    24.99 The competent court in the event of a dispute will be that of the place of residence of the defendant, or at the choice of the plaintiff, of the place of actual delivery of the Product.

APPENDIX 1: REPRODUCTION OF LEGAL PROVISIONS

Code de la consommation

Article L. 217-4 du Code de la consommation :

Le bien est conforme au contrat s'il répond notamment, le cas échéant, aux critères suivants :
  1. Il correspond à la description, au type, à la quantité et à la qualité, notamment en ce qui concerne la fonctionnalité, la compatibilité, l'interopérabilité, ou toute autre caractéristique prévues au contrat ;
  2. Il est propre à tout usage spécial recherché par le consommateur, porté à la connaissance du vendeur au plus tard au moment de la conclusion du contrat et que ce dernier a accepté ;
  3. Il est délivré avec tous les accessoires et les instructions d'installation, devant être fournis conformément au contrat ;
  4. Il est mis à jour conformément au contrat.


Article L. 217-5 du Code de la consommation :

I. En plus des critères de conformité au contrat, le bien est conforme s'il répond aux critères suivants :
  1. Il est propre à l'usage habituellement attendu d'un bien de même type, compte tenu, s'il y a lieu, de toute disposition du droit de l'Union européenne et du droit national ainsi que de toutes les normes techniques ou, en l'absence de telles normes techniques, des codes de conduite spécifiques applicables au secteur concerné ;
  2. Le cas échéant, il possède les qualités que le vendeur a présentées au consommateur sous forme d'échantillon ou de modèle, avant la conclusion du contrat ;
  3. Le cas échéant, les éléments numériques qu'il comporte sont fournis selon la version la plus récente qui est disponible au moment de la conclusion du contrat, sauf si les parties en conviennent autrement ;
  4. Le cas échéant, il est délivré avec tous les accessoires, y compris l'emballage, et les instructions d'installation que le consommateur peut légitimement attendre ;
  5. Le cas échéant, il est fourni avec les mises à jour que le consommateur peut légitimement attendre, conformément aux dispositions de l'article L. 217-19 ;
  6. Il correspond à la quantité, à la qualité et aux autres caractéristiques, y compris en termes de durabilité, de fonctionnalité, de compatibilité et de sécurité, que le consommateur peut légitimement attendre pour des biens de même type, eu égard à la nature du bien ainsi qu'aux déclarations publiques faites par le vendeur, par toute personne en amont dans la chaîne de transactions, ou par une personne agissant pour leur compte, y compris dans la publicité ou sur l'étiquetage.
II. Toutefois, le vendeur n'est pas tenu par toutes déclarations publiques mentionnées à l'alinéa qui précède s'il démontre :
  1. Qu'il ne les connaissait pas et n'était légitimement pas en mesure de les connaître ;
  2. Qu'au moment de la conclusion du contrat, les déclarations publiques avaient été rectifiées dans des conditions comparables aux déclarations initiales ; ou
  3. Que les déclarations publiques n'ont pas pu avoir d'influence sur la décision d'achat.
III. Le consommateur ne peut contester la conformité en invoquant un défaut concernant une ou plusieurs caractéristiques particulières du bien, dont il a été spécifiquement informé qu'elles s'écartaient des critères de conformité énoncés au présent article, écart auquel il a expressément et séparément consenti lors de la conclusion du contrat.

Article L. 217-12 du Code de la consommation :

Le vendeur peut ne pas procéder selon le choix opéré par le consommateur si la mise en conformité sollicitée est impossible ou entraîne des coûts disproportionnés au regard notamment :
  1. De la valeur qu'aurait le bien en l'absence de défaut de conformité ;
  2. De l'importance du défaut de conformité ; et
  3. De la possibilité éventuelle d'opter pour l'autre choix sans inconvénient majeur pour le consommateur.
Le vendeur peut refuser la mise en conformité du bien si celle-ci est impossible ou entraîne des coûts disproportionnés notamment au regard des 1° et 2°. Lorsque ces conditions ne sont pas respectées, le consommateur peut, après mise en demeure, poursuivre l'exécution forcée en nature de la solution initialement sollicitée, conformément aux articles 1221 et suivants du code civil. Tout refus par le vendeur de procéder selon le choix du consommateur ou de mettre le bien en conformité, est motivé par écrit ou sur support durable.

Article L. 217-16 du Code de la consommation :

Dans les cas prévus à l'article L. 217-14, le consommateur informe le vendeur de sa décision de résoudre le contrat. Il restitue les biens au vendeur aux frais de ce dernier. Le vendeur rembourse au consommateur le prix payé et restitue tout autre avantage reçu au titre du contrat.

Si le défaut de conformité ne porte que sur certains biens délivrés en vertu du contrat de vente, le consommateur a le droit à la résolution du contrat pour l'ensemble des biens, même ceux non couverts par le présent chapitre, si l'on ne peut raisonnablement attendre de lui qu'il accepte de garder les seuls biens conformes.
Pour les contrats mentionnés au II de l'article L. 217-1, prévoyant la vente de biens et, à titre accessoire, la fourniture de services non couverts par le présent chapitre, le consommateur a droit à la résolution de l'ensemble du contrat. En outre, dans le cas d'une offre groupée au sens de l'article L. 224-42-2, le consommateur a le droit à la résolution de l'ensemble des contrats y afférents.
Les obligations respectives des parties au contrat, mentionnées à l'article L. 224-25-22 et relatives aux conséquences de la résolution pour les contenus numériques et les services numériques, sont applicables à la résolution du contrat de vente d'un bien comportant des éléments numériques.

Article 1641 du Code civil :

Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.

Article 1648 du Code civil :

L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice. Dans le cas prévu par l'article 1642-1, l'action doit être introduite, à peine de forclusion, dans l'année qui suit la date à laquelle le vendeur peut être déchargé des vices ou des défauts de conformité apparents.

Pour l’Achat de produits ou services non exclus du périmètre du droit de rétractation, vous avez le droit de vous rétracter sans motif dans un délai de 14 jours à compter du jour où vous-même ou un tiers autre que le transporteur, prend physiquement possession du bien commandé.

En cas d’exercice du droit de rétractation, nous vous rembourserons tous les paiements reçus de vous, y compris les frais de livraison (à l'exception des frais supplémentaires découlant du fait que vous avez choisi, le cas échéant, un mode de livraison autre que le mode moins coûteux de livraison standard proposé par nous), sans retard excessif et, en tout état de cause, au plus tard 14 jours à compter du jour où nous sommes informés de votre décision d’exercer votre droit de rétractation.

Nous procéderons au remboursement en utilisant le même moyen de paiement que celui que vous aurez utilisé pour la transaction initiale, sauf si vous convenez expressément d'un moyen différent ; en tout état de cause, ce remboursement n'occasionnera pas de frais pour vous.
